These Terms of Service (“Terms”) govern your access to and use of the website located at coolcomfort-lkn.com (the “Site”) and the heating, ventilation, and air conditioning (“HVAC”) products, installation, repair, and maintenance services (collectively, the “Services”) provided by Cool Comfort Heating & Air (“Cool Comfort,” “we,” “us,” or “our”). By accessing the Site or requesting our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our Services.

1. Acceptance of Terms

By using our Site, scheduling an appointment, or accepting a quote or work order from Cool Comfort, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with any applicable estimates, invoices, and service agreements. These Terms apply to all visitors, customers, and others who access the Site or use our Services.

2. Services Provided

Cool Comfort provides residential and commercial HVAC services, including but not limited to the installation, repair, replacement, and routine maintenance of heating and cooling systems, furnaces, air conditioners, heat pumps, ductwork, and indoor air quality equipment. All Services are subject to a separate written estimate or service agreement that describes the specific scope of work, pricing, and terms for your project.

3. Estimates, Quotes, and Pricing

Estimates and quotes are provided for informational purposes and are valid for the period stated on the estimate, or for thirty (30) days if no period is specified. Pricing may change if the scope of work changes, if unforeseen conditions are discovered, or if equipment or material costs increase before work begins. Final pricing will be confirmed in your written service agreement or invoice. Any additional work beyond the agreed scope requires your approval and may incur additional charges.

4. Scheduling, Access, and Cancellations

You agree to provide safe and reasonable access to the areas of your property where Services will be performed. If our technicians are unable to access the property or the work area is unsafe, we may reschedule the appointment. Please notify us at least twenty-four (24) hours in advance to cancel or reschedule a non-emergency appointment. Missed appointments or late cancellations may be subject to a trip or service fee as disclosed at the time of booking.

5. Payment Terms

Payment is due upon completion of Services unless otherwise stated in your service agreement. We accept the payment methods identified on your invoice. Deposits may be required for certain installations or special-order equipment. Late payments may accrue interest and reasonable collection costs as permitted by applicable law. Title to any installed equipment remains with Cool Comfort until payment is received in full.

6. Warranties

Cool Comfort warrants that its labor and workmanship will be free from defects for the period stated in your service agreement. Equipment, parts, and materials are covered solely by the applicable manufacturer’s warranty, and we will pass through such warranties to you to the extent permitted. Warranties may be voided by misuse, neglect, unauthorized modification or repair, lack of recommended maintenance, or damage caused by factors outside our control. EXCEPT AS EXPRESSLY STATED, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

7. Limitation of Liability

To the fullest extent permitted by law, Cool Comfort shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of use, loss of comfort, or property damage not caused by our negligence. Our total liability for any claim arising out of the Services shall not exceed the amount you paid for the specific Service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Customer Responsibilities

You agree to provide accurate information about your property and existing systems, to disclose any known hazards, and to obtain any permissions required from property owners or associations. You are responsible for following our maintenance recommendations and operating your equipment in accordance with the manufacturer’s instructions. Failure to perform recommended maintenance may affect system performance and warranty coverage.

9. Use of the Website

The content on this Site, including text, graphics, logos, and images, is the property of Cool Comfort or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute Site content without our prior written permission. You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, or impair the Site. Any information submitted through the Site, such as contact forms or service requests, must be accurate and truthful.

10. Third-Party Links

The Site may contain links to third-party websites or resources that are not owned or controlled by Cool Comfort. We are not responsible for the content, products, or practices of any third-party sites, and we encourage you to review their terms and privacy policies.

11. Indemnification

You agree to indemnify and hold harmless Cool Comfort, its owners, employees, and contractors from any claims, damages, or expenses arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.

These Terms are governed by the laws of the state in which the Services are performed, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally shall be brought in the state or federal courts located in the county where Cool Comfort’s principal place of business is located.

The types of messages you may receive include appointment confirmations and reminders, service and dispatch updates, account or billing notifications, and promotional offers. Message frequency varies. Message and data rates may apply according to your mobile carrier’s plan. Cool Comfort and mobile carriers are not liable for delayed or undelivered messages.

You can opt out of receiving text messages at any time by replying STOP to any message you receive from us. After you send STOP, we will send a one-time confirmation message, and you will no longer receive text messages from that program.
